Will of James R. Wilson

I, James R. Wilson of Montgomery County, State of Kentucky, near the mouth of Aaron's Run Creek do this day make the following and my last Will and Testament, hereby revoking ant Will heretofore-

1st - After my death, I wish all of my debts and funeral expenses paid according to contract, any law to the contrary notwithstanding.

2nd - I will to my beloved wife, Hannah L. Wilson as her dower, one equal third of all my property or estate, real and personal to make up her dowerable share, she is to take such land as she may choose or select (price should she choose to do so or take the said personality at appraisement) and all my personal property she is to have and enjoy her said dower during her life, should she survive me and then same to decend to my children in equal proportion.

3rd - I will and bequeath all my property real and personal & dower to my wife and all (when said dower may decend) to my children to be divided among them in equal portions, they to have and enjoy the same during their lives and then it is to decend to my grandchildren, in equal portions and be theirs. I thus entail my property to keep it from being spent in wild and foolish young Americanism according to the style of the day. I wish it enjoyed but not wasted. I will the proceeds to raise & educate my children and I think it will be sufficient and all that they make in the way of profits will be theirs of course, should some of my children die without heirs the survivor or survivors are to inherit upon the same conditions as to decent as the deceased did. I mean bodily heirs, by all my property named above, I mean such as I may not hereinafter specially bequeath.

4th - Should the line of my bodily heirs all die or fail, in that event I will one equal third of all my property to my wife, Hammah L. Wilson to be hers absolutely and forever and to do with as she pleases and the other two thirds I will to my brothers and sisters in equal proportions to do with as they please.

5th - Much of my estate at this time is in money & promissory notes and should this be the case at my death, I wish my executor to collect the money as soon as they think best and buy land with it and have the land deeded in such manner that it will decend to my children in tha same manner as directed in section 3rd of this will. I have at this time 4600$ in gold and about 1100$ in Kentucky paper deposited. I want this to remain in kind till the War and the currency is better settled be the time long or short and then vested as above. I want the land bought and located as well as can be by my executors and friends to my family with plenty of timber on it. My wife is to be consulted with.

6th - My violin, silver tumbers, traveling pistol and family portraits, I will and bequeath to my wife and children forever as heirlooms.

7th - I give and bequeath to my wife my gold spectacles to be hers forever, should she survive me.

8th - When my property deeds to my children or to my brothers and sisters, I wish them to take per stirpes or by stock.

9th - I will & bequeath 300$ and if it is not enough more but not to exceed 500$ to buy a monument to go over my grave similar to the one over David S. Wilson's grave, but some larger with suitable inscription and to inclose the family graveyard where my Mother and others are buried with a strong wall put up. Stone wall 4 poles long and three poles wide, in which graveyard I wish to be buried in a line with my child James R. Wilson, Jr., and I wish a head and footstone to be put on his grave.

10th - I will and bequeath said graveyard where my Mother is buried 4 poles long 3 poles wide to my children and grandchildren, or to any member of the family should my line fail of children forever, not to be sold or conveyed or subject to debt or distress, but to be a family burying ground and I request my successors when my jurisdiction fails under the law to make a similar will, so that said graveyard may never pass out of tour family, it lies in Montgomery County, Kentucky on the Waters of Grassy Lick Creek bounded on the Northward by the land of William Henry, thence around on my land dor quantity.

11th - I appoint Daniel R. Jones and L. Dudley Wilson, my executors and bequeath to them the sum of 500$ for their trouble. I think this sum is enough as my estate is small and I think will be easily settled up, if they will not do it for this sum, I appoint my wife, Hannah L. Wilson, my executrix and she is to have the 500$; I appoint her my executrix in any event if she chooses, I give her the prefference, she can act with assistance of friends if she survives me.

12th - This will is written entirely in my own hand and I suppose needs no witnesses.

Codicil
I own 500$ stock in the Farmer's Bank of Kentucky, I wish my wife to have this as part of her dower in my estate and I would prefer her dower be made up of land and such of my goods & chattels not money as she may select. Any of the land I now own I will that it may be sold and the money reinvested by a commissioner or myt executor. When the reinvestment is made it is to be deeded as heretofore expressed and directed in this Will, the Land bought is to pass the same way to my heirs as the land sold provided the land must lie in the Counties of Bourbon and (or) Franklin or some county not so wild as to Taxation as Montgomery, Bath and some others. I wish all the money and proceeds of promissory notes I have at my death laid out in Land in Bourbon or Franklin Counties or some County clear of County Tax for internal improvements, if such a county can be found, and I wish no sale and reinvestment made but one time after it is reinvested once it is to remain, the object being to get it to some other county and to get better land, nearer level if not so rich.
I have erased the names of Daniel R. Jones and L. Dudley Wilson as my executors and appointed L. C. Jeffries as he lives near and a most excellent man to handle estates, he keeps the money to its self and a good book.
This is in my own Hand and I suppose needs no witnesses.
June 10th, 1869 James R. Wilson.9 He wrote a codicil on 10 June 1869 at Aaron's Run, Kentucky.10 He appeared on the census of 1 June 1870 at Aaron's Run, Kentucky.11 He died on 15 December 1870 at Montgomery County, Kentucky, at age 64.9 He was buried after 15 December 1870 at Wilson-Caywood Graveyard, Aaron's Run, Kentucky, at 3:00 PM.9 He was re-buried after 16 December 1870 at Machpelah Cemetery, Mt. Sterling, Kentucky, from the graveyard on his farm near Aaron's Run.9
